1. NO PURCHASE NECESSARY TO PARTICIPATE IN HAWAII.COM'S LOYALTY PROGRAM. Hawaii.com reserves the right to review Hawaii.com Membership and Member activity which could result in termination of the account or disqualification of points. All Federal, State, Local and Municipal laws and regulations apply. Void where prohibited.

2. Eligibility. Loyalty Program is open to all Hawaii.com Club members 18 years or older at the time of Joining the Hawaii.com Club except employees of Hawaii.com, Gannett Co., Stephens Media Group, and each of their respective affiliated companies, subsidiaries, and advertising or promotional agencies, and the immediate family members of, and any persons domiciled with, such employees.

3. Earning Points. Earn Points by joining Hawaii.com (100 points) and thereafter, logging into Hawaii.com each time you visit the site and participating in various activities. These activities and their resulting points awards are as follows:
• Participate in Hawaii.com's forums (10 points for creating a new topic; 5 points for responding to an existing topic)
• Join the Hawaii.com Golf Country Club (50 points)
• Click on PowerLinks in Hawaii.com's e-mail alerts (20 points)
• Send an e-Postcard to family and friends (30 points)
• Polls and surveys (30 points)
• Refer a friend to be a member (100 points)
• Get your Hawaii/Hawaii-travel-related questions answered in the Hawaii.com help log (30 points)
• Purchase a special-events or other travel package, as promoted specifically by Hawaii.com (1 point per dollar spent)

Members will be notified if additional methods to earn points are added to the site.

Hawaii.com, Gannett Co. and Stephens Media Group ("Sponsor") will not be responsible for lost or misdirected points, or for failure to receive points due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with sender or Sponsor. In the event of a dispute, all points will be deemed to have been earned by the owner of the email account with which the Member has registered. Any questions regarding the number of points earned shall be assessed and determined by Sponsor in its sole, reasonable discretion, and Sponsor reserves the right to reject any points by persons determined to be tampering with or abusing any aspect of the points earning or redemption process.

4. Redeeming Points. Points can be used exclusively in the Hawaii.com Member Store to acquire products. Points have no cash or monetary value. All points awards are outlined in the Earning Points section above. All product offerings are featured on the Loyalty Program page or in the Member Store.

All points must be redeemed during the calendar year they are earned. No points will carry over from year to year. For example: A point earned between 1/1/2009 and 12/31/09 will be deleted from the Member's Account at 11:59 p.m. on 12/31/09 and will no longer be available for redemption.

There is no limit to the amount of points that can be redeemed, as long as products are available in the Hawaii.com Member Store. Gift items are also available for purchase outside the Loyalty Program.

5. Loyalty Program Participation. By participating, entrants agree to be bound by these Official Loyalty Program Terms & Conditions and the decisions of the Hawaii.com staff. Participants also agree to be bound by the terms & conditions set forth by Hawaii.com's Privacy Policy.

Hawaii.com reserves the right to disqualify from Membership any persons found tampering with or otherwise abusing any aspect of this Loyalty Program as solely determined by Hawaii.com.

In the event the Loyalty Program is compromised by a virus, non-authorized human intervention, tampering or other causes beyond the reasonable control of Sponsor which corrupts or impairs the administration, security, fairness or proper operation of the Loyalty Program, Sponsor reserves the right in its sole discretion to suspend, modify or terminate the Loyalty Program.

6. Construction. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Loyalty Program Terms & Conditions, or the rights and obligations of any Member and Sponsor, shall be governed by, and construed in accordance with the laws of the state of Delaware without giving effect to any choice of law or conflict of law rules or provisions (whether of the state of Delaware, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than Delaware. The invalidity or unenforceability of any provision of these rules shall not affect the invalidity or unenforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.

7. General Release. By participating, contestants release Hawaii.com, Gannett Co., Inc., Stephens Media Group, any other promotional sponsors, and each of their respective affiliated companies, directors, officers, employees, representatives, partners and agents from any liability whatsoever for any claims, costs, injuries, losses or damages of any kind arising out of or in connection with the Loyalty Program or with the acceptance, possession or use of any points (including, without limitation, claims, costs, injuries, losses or damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light).
